ITEM2PIN® Terms of Use
Please read the conditions written below to use the website named item2pin.com. By visiting the website www.item2pin.com or becoming a Member, you hereby accept, declare and undertake that you have read these Terms of Use, fully understood their content, unconditionally accepted all matters specified in the Terms of Use and on the Platform and to be added later, and that you will not raise any objections regarding all matters specified on the Platform.

If you do not accept these conditions, please stop using the Platform and close this website.

1. ITEM2PIN® Platform
1.1. The owner of the ITEM2PIN.com website (hereinafter referred to as the “Site” or “Platform”) and the platform where the services are provided on this site is ITEM2PIN Bilişim Ltd.Şti. located at “Çınarlı Mah. 1572 Sok. No:33 Konak / İZMİR”. (hereinafter referred to as "ITEM2PIN®"). The services offered on the Platform are provided by ITEM2PIN®.

1.2. All kinds of discretionary authority on the Site belongs to ITEM2PIN®. ITEM2PIN® may change these Terms of Use, any information and content on the Platform at any time without any notice or notification to the User. These changes will be valid on the date they are published on the Site.

2. Definitions
Platform: The website or mobile applications where ITEM2PIN® offers its services, consisting of the domain name www.item2pin.com and the subdomains connected to this domain name.

User: Any real or legal person accessing the Platform.

Member: The User who opens an account on the Platform and benefits from the services offered on the Platform under the conditions specified in the Membership Agreement.

Services: Applications offered by ITEM2PIN® to enable users to perform transactions related to electronic commerce transactions on the Platform. ITEM2PIN® may make changes and/or adaptations to the Services offered within the Platform at any time.

Content: Any type of text, image, video, information, file, number, etc. visual, written and auditory images published and accessible on the Platform.

3. Terms of Use and User Obligations
3.1. The User accepts and undertakes from the outset that they will use the Platform in accordance with the law, to comply with the provisions of the legal legislation while using the Platform and not to violate them. Otherwise, all legal and criminal liabilities that may arise will bind the User completely and exclusively.

3.2. Users who purchase products or services through the Platform within the scope of non-membership shopping accept that they are subject to the obligations set forth in the Membership Agreement, limited to the transaction they perform.

3.3. ITEM2PIN® does not guarantee the accuracy, reality, security and legality of the advertisements, comments and Content added by Members and viewed by Users under any circumstances. Users accept and declare that ITEM2PIN® has no responsibility for the said advertisements and Content, and that ITEM2PIN® will not have any compensation obligations for any damages that may arise.

3.4. The User accepts and undertakes that they will not use the Platform in a way that disrupts public order, is against general morality, disturbs and harasses others, for an illegal purpose, is illegal, constitutes a crime, harms personal rights, violates intellectual rights, copyrights, trademark rights and property rights, will not engage in activities that will lead to unfair competition, will not perform acts that will damage the personal and commercial reputation of ITEM2PIN® and third parties, violate or attack personal rights, will act in accordance with the legislation, will take the measures and fulfill the procedures required by the legislation, will not advertise content that will create discrimination based on gender, race, color, language, religion, belief, sect, philosophical and political views, ethnic origin, wealth, birth, marital status, health status, disability and age, and will not exhibit attitudes and behaviors towards this end. 

3.5. The User is obliged to use the information they access within the scope of the Platform only in accordance with the purpose of the Member or ITEM2PIN® who made this information public and to display it for non-commercial purposes. Personal data belonging to the Member or third parties protected under the Law No. 6698 on the Protection of Personal Data that may be included in the advertisements and content cannot be used for any other purpose, copied, published directly or indirectly in other media, processed, distributed, transferred to other databases and made accessible and usable by third parties. 

3.6. Using the whole or any part of the Platform for the purpose of disrupting, changing or reverse engineering, attempting to break API protocols by reverse engineering or any other method and unauthorized access to parameters such as the API key, API secret key, request headers, client verification algorithm or unauthorized sharing of these parameters with third parties, attempting to access the Site in a way that prevents, disrupts or interferes with the communication or technical systems of the Platform, using any automatic program, robot, spider, web crawler, spider, data mining, data crawling etc. on the Site. In case of screen scraping software or systems, automatic tools or manual processes, unauthorized access to other users' data or software, bot operation as a result of detections to be made according to various criteria, DDOS attacks and all kinds of attacks aimed at the whole or part of the systems, changing, reducing or destroying the current performance and all kinds of attacks on the system and other illegal uses, such uses will be prevented at the discretion of ITEM2PIN®. Even if such uses do not occur, ITEM2PIN® may allow the use of the Platform only after the Member logs in with his/her username and password, if it deems necessary. The use of the Site and the content on the Platform outside the usage limits determined by the Terms of Use is against the law; ITEM2PIN® reserves all kinds of claims, lawsuits and follow-up rights. In case of detection of use contrary to these terms and laws; ITEM2PIN® has the right to report and complain about the User to the competent authorities. The User accepts and undertakes that he/she is personally responsible for the damages and demands arising from such uses.
3.7. ITEM2PIN® provides the Platform as is without any guarantee of use. The User accepts and undertakes that ITEM2PIN® cannot be held responsible for any direct and indirect damages that may occur in the event of interruption of the service provided on the Platform, disruptions, delays, failures in information transmission, and data loss.
3.8. The information accessed within the scope of the Platform and all elements of the Platform's Database, Interface, design, text, image, html code and other codes -including but not limited to- all content subject to ITEM2PIN®'s copyrights belong to ITEM2PIN® or are licensed by ITEM2PIN® from a third party. The User does not have the right to sell, process, share, distribute, exhibit ITEM2PIN® services, ITEM2PIN® information and works subject to ITEM2PIN®'s intellectual property and copyrights, or allow anyone else to access or use ITEM2PIN®'s services. The User may not reproduce, process, distribute or create derivative works from the content subject to ITEM2PIN® copyrights, except in cases where it is expressly permitted by ITEM2PIN® under the Terms of Use. These content and works may not be used for training machine learning, deep learning or any artificial intelligence algorithm. Unless expressly authorized by ITEM2PIN® under these Terms of Use, ITEM2PIN® reserves all rights to ITEM2PIN® services, ITEM2PIN® information, ITEM2PIN® copyrighted content, ITEM2PIN® trademarks or other assets and information provided through this site.

4. General Provisions

4.1. Applicable Law: In the event that there is a foreign element in the implementation, interpretation and management of legal relations arising within this scope of these Terms of Use, Turkish Law shall be directly applied, excluding the Turkish conflict of laws rules.

4.2. Jurisdiction: Izmir Courts and Enforcement Offices are authorized to resolve any disputes arising or that may arise within the scope of these Terms of Use.

4.3. Partial Invalidity: The invalidity, illegality or inapplicability of any one or more provisions of the Terms of Use shall not eliminate the validity of the remaining provisions.

4.4. Enforcement: These Terms of Use shall enter into force on the date they are published on the Platform by ITEM2PIN®. Users are deemed to have accepted these Terms of Use and any changes to these conditions by using the Platform.
